Our services are operated by Kenneth Hall, trading as The Pathway Porter. Whether the services are arranged directly with us or one of our appointed sales agents your contract is with The Pathway Porter.
By placing an order for baggage transfer and accommodation services or hire equipment and/or consumables from The Pathway Porter you are agreeing to these Terms and Conditions.
The order you place with us is an offer by you to enter into a binding contract with us, which we are free to accept or decline at our absolute discretion. A binding contract will exist between you and us when we issue you with written acceptance of your order, or we notify you that we are able to provide the service, or we perform the services, whichever is the earlier. At this point a contract shall come into existence between us.
If you are a consumer and you place your order by internet or telephone you are entitled to terminate your order without charge within 7 days from the point a contract is made. Cancellation during the cooling off period must be by email to info@thepathwayporter.com
BAGGAGE TRANSFER AND ACCOMMODATION SERVICE
Booking & Payment
Full payment must be received by credit or debit card, a cheque or bank draft. Clients using our accommodation booking service must provide credit card details with a date of expiry later than the date of the last hotel booking. Please note that your credit card will not be debited or your other payment processed immediately at the point of order. This will be done when we have reviewed your requirements and accepted your order.
Bags should weigh no more than 20 kilos . Our insurance does not permit us to drop-off baggage in places that are unattended. In the event that there is no-one to receive your baggage it will be left at a convenient dropping point and must be collected at the end of your days walk. We undertake to collect and deliver your baggage to the next accommodation by 4.30pm. Baggage must be ready for collection by 9am, clearly labelled and securely packed without loose items attached. We prefer that your baggage is also locked.
Accommodation booking services
When we book accommodation on your behalf we act only as your agent. Your contract for your accommodation is with the property owner/hotelier. Our responsibility ends when we have confirmed the rooms as requested. We are not involved in the day to day running of any of the properties and therefore not liable for the quality of service received. Any complaints must be addressed to the hotel proprietors. We have made reasonable efforts to establish that the properties we list provide a suitable service, however, the inclusion of a property in our services does not constitute a recommendation. We are pleased to hear about any hotel that fails to meet appropriate standards of service.
The prices of rooms quoted is the latest supplied by the hotelier, and represents an average room cost. Room prices may vary slightly from room to room within a hotel by virtue of their position, facilities and view.
Prices are per person based on two people sharing and are for bed and Breakfast only, evening meals and packed lunches are not included. (please note that in youth hostels breakfast is not usually included and where available must be paid for separately. Whilst we reserve the hotels on your behalf, you pay the hoteliers directly as you follow the trail. Whichever hotels/accommodation you select it is inevitable that on some nights your choice will not be available. In such cases we will provide the best alternative available.
Alteration of Bookings
If you wish to change your hotel arrangements subsequent to us having booked there will be an amendment fee of €10 per person
Cancellation
Hoteliers extend the facility and convenience to our clients to book without deposits and all the administration that involves, they must however be protected against no shows, and last minute cancellations. You are advised to take out suitable travel insurance at the time of booking. Should you subsequently cancel your arrangements or fail to show without notice cancellation charges may be levied by the accommodation provider according to their terms and conditions.
A credit card with an expiry date later than the last nights accommodation booked must be provided at the time of payment.
Group Bookings
It may not always be possible to book large groups into the same hotel. If it becomes necessary to split groups, every effort will be made to book all the guests into properties that are close together.
If you are able to start your walk mid week do so. Most people start at weekends and this creates bottlenecks at points on trails where there is limited accommodation.
Information about your Requirements
You must provide us, in sufficient time, with any information and instructions relating to your requirements that is, or are necessary to enable us to provide the services in accordance with the contract between us and you including these Terms and Conditions. If you do not, or you provide us with incomplete or inaccurate information or instructions, we may cancel your order by giving you written notice, or we may make an additional charge of a reasonable sum to cover any extra work that is required.
Your statutory rights are not affected
Payment Method
Our preferred method of payment is either by bank transfer or credit/debit card once your booking is confirmed. Alternatively, and by prior arrangement only, we can take cash at the time of delivery.
Cancellations
Whilst The Pathway Porter understands things can change, all orders cancelled outside any statutory cooling-off period for consumers that applies and within 48 hours of a delivery date will incur a charge equal to 50% of the original order. All other cancellations outside any statutory cooling-off period for consumers that applies will incur a small administration fee of €5,00.
Equipment Deposit
If a deposit is requested it must be paid (by cash or debit/credit card) at the time of booking or on commencement of the hire contract. Such sum shall be returnable at the end of the hire if the item hired is returned in substantially the same condition as when hired out BUT all or part of this sum may be forfeited if the item returned is not in the same good state and condition as at the commencement of the hire period or all conditions have not been met.
EVENTS OUTSIDE OUR CONTROL
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under the contract between you and us including these Terms and Conditions that is caused by events outside our reasonable control (Force Majeure Event).
A Force Majeure Event includes any act, event, non-occurance, omission or accident beyond our reasonable control and includes, in particular (without limitation), the following:
* civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for way; or
* fire, explosion, storm, flood, earthquake, subsidence, epidemic, other exceptional weather or natural disaster; or
* impossibility of the use of motor transport or other means of public or private transport on private or public roads; or
* impossibility of the use of public or private telecommunications networks including mobile ‘phone networks.
LIMITATION OF LIABILITY
Except for the types of losses listed below, if either of us fails to comply with the terms of the contract between you and us including these Terms and Conditions, neither of us shall be responsible for any losses that the other suffers as a result, except for those losses which we or you could reasonably foresee would result from the failure to comply with the terms of the contract.
Neither of us shall be responsible for losses that result from our failure to comply with the contract between us, including these Terms and Conditions, that fall into the following categories:
* loss of opportunity
* loss of a bargain
* loss of anticipated savings; or
* loss of data
We expect you to pack sensibly when using the Baggage Transfer service and not to pack high-value or luxury items unless it is necessary. In the event of loss of or damage to, your luggage which is due to a breach of any of our obligations under the contract for the Baggage Transfer service between you and us, including these Terms and Conditions, our liability for foreseeable loss of, or damage to your property, shall not exceed our insurance limits, as follows:
* €2,000 per item of luggage effected for claims by you; or
* €400 per item of luggage effected for claims by your insurer.
This clause does not limit or exclude in any way our liability for death or personal injury caused by our negligence, or fraud or fraudulent misrepresentation, or any other matter for which it would be illegal or unlawful to exclude or limit or attempt to exclude or limit our liability.
If you are a consumer you have certain statutory rights in the event that our services is defective and you suffer loss or damage. Your statutory rights are not affected
GENERAL
